Antitrust

The Firm has substantial experience advising clients in connection with a broad range of sophisticated domestic and international antitrust issues, including those arising in the context of cross-border acquisitions, joint ventures, requirements contracts and similar contractual arrangements, and other business practices. In addition, it has been engaged in connection with complex antitrust litigation, including cases involving alleged price-fixing, monopolization and predatory practices.

The antitrust practice is based in the Washington, D.C. office. Jeffrey I. Zuckerman, resident partner in Washington, D.C., and an acknowledged expert in antitrust law, is a former Director of the Bureau of Competition at the Federal Trade Commission and Special Assistant to the Assistant Attorney General in charge of the Antitrust Division at the U.S. Department of Justice.

  • Capital Currency Exch. v. National Westminster Bank PLC (U.S. District Court, NY, 2d Cir.) Application of forum non conveniens to antitrust suits .
  • Ping He Co. v. Nonferrous Metals (U.S.A) Inc. (U.S. District Court, New York) Dispute over commodity futures trading account.
  • U.S. v. Detia-Degesch GMBH (U.S. District Court, Kansas) Criminal price-fixing cases involving aluminum phosphide pellets and tablets.
  • POM v. Duncan (U.S. District Court, Arkansas) Alleged monopolization of parking meter systems.
  • California Slim v. Slimfast (U.S. District Court, California) California antitrust case in which Slimfast was accused of being monopolistic and engaging in predatory practices.
  • Minpeco, S.A. v. Conticommodity Servs. (U.S. District Court, New York) Representation of a foreign investor in disputes arising out of the silver crisis, involving alleged manipulation of the silver markets and violation of the antitrust laws.
  • In re Grocery Products Grand Jury Proceeding (Connecticut) Case concerning possible criminal antitrust violations by supermarkets operating in Connecticut and Western Massachusetts.
  • National Super Spuds, Inc. v. New York Mercantile Exchange (U.S. District Court, New York) Representation of major potato growers and officers and directors in cases involving alleged manipulation of Maine potato futures.
  • Strobl v. New York Mercantile Exch. (U.S. District Court, New York) Claims arising out of trading in the May 1976 Maine Potato Futures Contract.
  • P.J. Taggares Co. v. New York Mercantile Exch. (U.S. District Court, New York) Representation of P.J. Taggares in connection with various aspects of its failure to deliver under Maine potato contracts sold through the New York Mercantile Exchange.
  • Puerto Rico Maritime Shipping Auth. v. Star Lines Ltd. (U.S. District Court, New York) Representation of a shipping company in cases involving arbitration of the principal-agency relationship and violation of antitrust laws.
  • COFINCO v. Angola Coffee Co. (U.S. District Court, New York) Representation of a commodities trading company and its officers in a private enforcement action alleging monopolization of the world coffee market.
